The high-profile Usindiso fire trial has taken another dramatic turn after accused Sithembiso Mdlalose retracted his confession in court. Proceedings have been adjourned until 15 October 2025, following his sudden walkout during cross-examination.
Mdlalose, who had previously admitted to starting the deadly blaze, told the court he had lied about his involvement. He claimed his original statement was made while he was under the influence of drugs and desperate for basic needs such as food and shelter.
“At the time of the confession, I was high,” Mdlalose said. “Now I am sober, and I want the truth to be known. I lied, and I know the public deserves honesty about what really happened.”
He added that he thought going to prison might give him “a second chance” in life.
When prosecutor Thami Mpekana pressed him on the contradictions in his testimony, Mdlalose responded mockingly, suggesting he could “create” any story if the court preferred.
Before leaving the stand, he told the prosecutor:
“If you are a prophet, then that version is true. I don’t know now if you are a prophet or a prosecutor.”
Judge Cassim Moosa postponed the trial, noting that Mdlalose’s mental state needed to be considered in the interest of justice.

These charges stem from the August 2023 Usindiso building fire in central Johannesburg, where dozens of lives were lost in overcrowded and unsafe conditions.
The case has been marked by contradictions. In January 2024, Mdlalose admitted before the Usindiso Inquiry that he caused the fire. The court later ruled the confession was admissible as it was made “freely and voluntarily.”
Now, however, he insists the confession was fabricated.
His father, Bheki Khumalo, expressed disappointment, stressing that his son was “never homeless” and had family support. He called for a psychological evaluation after witnessing his son’s erratic behavior in court.
Despite the retraction, prosecutors remain confident. They argue that evidence still places Mdlalose at the scene of the fire and maintain that his earlier confession should stand.
The case will continue on 15 October 2025, prolonging the wait for victims’ families who have been seeking justice for more than two years since the tragedy.
