
Advocate Terry Motau Requests Exit from Madlanga Commission of Inquiry

Pretoria, South Africa – During testimony at the Madlanga Commission of Inquiry, Lieutenant General Nhlanhla Mkhwanazi raised serious concerns about the judicial system’s handling of high-risk offenders after discussing the case of Fisokuhle Ntuli.
Ntuli, who was previously convicted and sentenced for four counts of attempted murder in the Pat Fontaine case (June 2016), had appealed his conviction and was granted bail pending the appeal.
According to Mkhwanazi, during this period of temporary release, Ntuli allegedly committed four additional murders linked to several Nongoma cases between 2016 and 2018, specifically:
In addition, Ntuli faced charges for possession of unlicensed firearms in Nongoma Case 285 of 2017 and Nongoma Case 147 of 2018.
Mkhwanazi expressed alarm at the repeated pattern of granting bail to high-risk offenders, stressing that the system’s leniency allowed Ntuli to commit further violent crimes while under judicial supervision.

“This case demonstrates a critical gap in how bail is managed for accused individuals with a proven record of violence,” Mkhwanazi told the Commission. “When someone convicted of attempted murder is released pending appeal and goes on to commit multiple additional murders, it is a clear indication that current bail practices are failing to protect society.”
