
Fikile Mbalula Takes Legal Action Against Brian Mogotsi Over Defamation Claims

Johannesburg – The Madlanga Commission of Inquiry has formally issued a Rule 3 notice to North West businessman Brown Mogotsi, notifying him that he has been implicated in evidence presented before the commission and giving him the right to respond.
The commission, chaired by retired Constitutional Court Justice Mbuyiseli Madlanga, is probing allegations of criminal interference, political protection networks, and corruption within South Africa’s criminal justice system.
During recent hearings, Lieutenant General Dumisani Khumalo, head of Crime Intelligence, submitted evidence that included WhatsApp messages allegedly exchanged between Mogotsi and businessman Vusimuzi “Cat” Matlala — who is currently facing charges of attempted murder and money laundering.
According to Khumalo’s testimony, the messages suggest that Mogotsi may have been involved in coordinating payments and leaking sensitive information to aid criminal operations.
Investigators traced a R37,000 transaction from Matlala to Gotlhe Specialists, a Mahikeng-based business allegedly connected to Mogotsi. The commission also heard that Mogotsi allegedly tipped off Matlala about upcoming counter-intelligence raids and played a role in dismantling investigative teams targeting him.
The African National Congress (ANC) has sought to distance itself from Mogotsi amid the mounting controversy.
ANC Secretary-General Fikile Mbalula confirmed that Mogotsi’s membership expired in 2020 and was never renewed, saying the party does not associate with individuals implicated in corruption.
“Brown Mogotsi is a reflection of a bad ANC member if he is, because he is implicated in siphoning money in the name of the ANC,”
said Mbalula.

In response, Mogotsi has denied any criminal involvement, insisting that he remains a law-abiding businessman and innocent of the allegations.
He has challenged the ANC to produce proof of his expired membership, maintaining that he continues to be a member in good standing.
“I am ready to appear before the commission and tell my side of the story,” Mogotsi stated in an interview.
The Madlanga Commission was established to investigate corruption and interference within the country’s law enforcement and intelligence agencies.
Its mandate includes uncovering networks of influence that allegedly protect politically connected individuals from accountability. The commission’s findings are expected to form the basis for criminal prosecutions and policy reforms aimed at restoring integrity in public institutions.
As the inquiry proceeds, Mogotsi is expected to be formally called to testify in the coming weeks.
